This meeting will be a discussion of Facebook, Inc. v. Sound View Innovations LLC, IPR2017-00985. Before filing of its IPR petition, Petitioner Facebook had argued in district court that limitations reciting a “controller” rendered a claim indefinite because they should be construed as means-plus-function limitations under 35 U.S.C. ¶ 6, and the specification did not provide sufficient structure corresponding to the claimed functions. In its petition, however, Facebook attempted to argue that the term “controller” should not be interpreted under 35 U.S.C. ¶ 6 for the purposes of the IPR. The Board denied institution of some of Facebook’s challenged claims because of this apparent inconsistency. It is requested that meeting attendees review at least the Board’s decision on institution and the decision denying Facebook’s request for rehearing.
