Antitrust Scrutiny of Trademark Settlements:  Through the Lens of 1-800 Contacts

In what purports to be a far-reaching decision on the blurry line between trademark rights and anti-competitive behavior, the Second Circuit is reviewing the Federal Trade Commission’s recent ruling that 1-800 Contacts’ settlements with competitors violated antitrust law.  The FTC found that the settlements, which would prevent competitors from legitimately bidding or purchasing keywords including “1-800 Contacts” for online search advertising, unlawfully restricted the competitors’ ability to engage in search engine marketing.  

Join us for a brown bag luncheon to discuss the implications 
of In the Matter of 1-800 Contacts, Inc. on settling trademark infringement claims and how companies can best protect their brands and themselves from antitrust scrutiny.
