This month, we’ll be discussing the Federal Circuit’s recent decision in Omega Patents, LLC v. CalAmp Corp., No. 2018-1309 (Fed. Cir. Apr. 8, 2019). A jury concluded that Omega’s four remote vehicle control and monitoring patents were infringed and not invalid. The Federal Circuit ordered a new trial on three patents but held that there was sufficient evidence for a reasonable jury to find that CalAmp directly infringed one patent. Further, the Federal Circuit affirmed the judgment as to validity after determining that CalAmp failed to preserve its objections to the district court’s claim construction ruling. We’ll explore several interesting issues in this case, including the Federal Circuit’s determination that CalAmp should have offered for admission into evidence, or at least specifically identified, the prior art that CalAmp believed was impacted by the claim construction ruling; its holding that although CalAmp did not make or sell infringing products, CalAmp’s customers used the claimed system; its discussion of the district court’s obligation to construe claims; and its conclusion that the district court improperly excluded testimony related to CalAmp’s state of mind.
