This meeting will focus on a discussion of Mark A. Barry v. Medtronic, Inc. (Fed. Cir. January 24, 2019).  The main issues in this case are the public use and on-sale bars to patentability and how the experimental use exception may apply to these bars.  A sole inventor applies for patents for his invention one year after he used the invention and charged market rate for the use.  The patent is granted.  Later, he sues a large company for infringement.  The company offers public use and on-sale bar as defenses.  The inventor argues that experimental use exception applies to his use of the invention.  The Federal Circuit panel hearing the case is divided, with the majority agreeing with the inventor and the dissent strongly disagreeing.  Does the experimental use exception apply under the facts of the case?  Was the invention ready for patenting?  Arguments presented on both sides will be discussed.
