For this first month of fall 2018, we will discuss whether the statutory requirement for a “written description of the invention” is properly independent of that for “enablement” under 35 U.S.C. § 112(a).  This question, while it has been highly controversial and the issue of several prior Federal Circuit cases, has never been addressed by the Supreme Court, and is now the basis for a recent petition for certiorari in Amgen Inc v. Sanofi, 872 F.3d 1367 (Fed. Cir. 2017).  Specifically, Amgen is requesting the Court to overturn the current written description judicial standard that requires a demonstration of “possession by the inventor” in favor of an extension of the current enablement standard as a function of the plain meaning of the statute.
