Brown Bag Lunch Meeting

Please join us for a members-only brown bag lunch to discuss the USPTO’s Request for Comments on Determining Whether a Claim Element Is Well-Understood, Routine, Conventional for Purposes of Subject Matter Eligibility.  The USPTO has proposed updated examination guidance based on the Federal Circuit’s recent holding in Berkheimer v. HP Inc. that whether a claim element represents well-understood, routine, or conventional activities to a skill artisan is a question of fact.  The guidance clarifies that an examiner’s conclusion that a particular claim element (or combination of elements) is well-understood, routine, or conventional must be made based on a factual determination that is supported in writing.  During this meeting, we will discuss the examination guidance, as well as comments on the examination guidance that the BPLA will consider submitting on behalf of its members.
