This month, we will be discussing the Federal Circuit’s decisions on reasonable royalties in:
Finjan v. Blue Coat, Exmark v. Briggs & Stratton, and AstraZeneca AB v. Apotex Corp.
In each case, the Federal Circuit considered how claim scope affected the royalty base for calculating a reasonable royalty.
Together, these cases show that the royalty rate must be apportioned based on the incremental value of a claim’s novel elements, while the royalty base must be apportioned based on the incremental value the patented features add to the accused product.
