This meeting will be a discussion of Microsoft Corp. v. Biscotti, Inc., 878 F.2d 1052 (Fed. Cir. 2017). Microsoft appealed the PTAB’s decisions finding no anticipation in multiple IPRs that Microsoft filed against various claims of  Biscotti’s asserted U.S. Patent No. 8,144,182 (“the ‘182 patent”). The PTAB rejected Microsoft’s arguments that U.S. Patent No. 7,907,164 (“Kenoyer”) anticipated the “storage medium” and “instructions for” limitations of Biscotti’s Independent Claim 6. Particularly, the PTAB found that Microsoft’s relied-upon portions of Kenoyer did not describe the same embodiment and thus Kenoyer did not disclose a single embodiment teaching every limitation of Biscotti’s Independent Claim 6. The PTAB also rejected Microsoft’s arguments that Kenoyer taught the “interface” limitation of Biscotti’s claims, finding that Microsoft’s arguments again relied on improperly combining separate embodiments of Kenoyer. The Federal Circuit affirmed, finding that the PTAB had applied the correct standard for determining anticipation and the PTAB’s findings were based on substantial evidence. To discuss the merits and implications of this case, meeting attendees should at least review the Federal Circuit’s decision. This is a fact-intensive case, so meeting attendees will also probably want to review the challenged independent Claims 6 and 69 of the ‘182 patent and the Kenoyer reference.
