Our intellectual properties department has a new position for an Assistant Intellectual Property Counsel. This position will have the legal responsibility for supporting corporate non-litigation and litigation related intellectual property matters of Fresenius Medical Care NA under supervision of Chief IP Counsel. This position will be responsible for preparation and supervision of original patent applications, patent prosecutions, non-infringement/freedom to operate opinions, interaction with the U.S. Patent and Trademark Office.

PRINCIPAL RESPONSIBILITIES AND DUTIES

·         Direct, maintain, manage and protect the intellectual property portfolio of Fresenius Medical Care NA while ensuring compliance with company policies and procedures and applicable government regulations.

 

·         Responsible for all items and functions pertinent to:

Ø  Preparation of 10-12 Patent applications or equivalents per year

Ø  Non-infringement and freedom to operate opinions as directed

Ø  Prepare Intellectual Property licenses and other IP related agreements as required.

 

·         Coordinate closely with product research and development personnel and facilities in all U.S. subsidiaries and with patent department(s) at related foreign affiliates to ensure the appropriate documentation, processes and procedures are followed. 

 

·         Review intellectual property portfolios of competitors and develop intellectual property strategies to maximize and protect the Company’s competitive position. 

 

EDUCATION

·         Technical degree – at least a bachelor’s in engineering, electronics with a software background preferred.  Will consider chemistry, chemical engineering, physics, math, or equivalent discipline with computer science experience or minor; or equivalent experience in technical fields to equate to advanced technical study.

·         Juris Doctor Degree, member of a state bar, member of US patent bar (Registered at US Patent and Trademark office).

 

EXPERIENCE AND REQUIRED SKILLS

·         At least 2-5 years as patent attorney or agent.

·         Knowledge of applicable regulations, executive orders, precedents, and legal codes.

·         Excellent communication skills – verbal and written – must be articulate and be a good listener.

·         Good computer skills.

Job Description

Develops, communicates and executes substantive Intellectual Property (“IP”) training as it relates to IP staff which includes, but not limited to, paralegals, patent administrators and secretaries across all offices. Works closely with the IP Director to ensure the continued professional development of the IP staff with a heavy focus on patent prosecution.   

Works with the Director of IP and other members of the IP team to identify and address training needs, develop curricula, and implement programs to maximize effectiveness and quality.

Ensures that internal policies, programs and processes are developed, communicated, and implemented in compliance with Firm objectives and relevant USPTO laws/regulations and Firm objectives.

Establish and implement a strategic IP Staff Training program, including short and long term training goals and objectives.

Establish and maintain internal and vendor relationships with the goal of continuously improving the IP Staff Training services to the Firm.

 POSITION SUMMARY:
As a patent agent, you will help protect the Company’s valuable and growing intellectual property. This is vital role on the Patent team in which you will work with inventors/engineers/designers in preparing and prosecuting US and Foreign patent filings with outside counsel. Portions of the job include conducting various patent searches, competitive landscape assessments (patentability, right-to-use, infringement, validity analyses and freedom-to-practice evaluations), developing and implementing offensive and defensive IP strategies, providing support for patent litigation, and providing timely counsel on intellectual property issues.
 
RESPONSIBILITIES / DUTIES:
  • Collaborate with inventors/engineers in collecting materials for invention disclosures to ensure complete, perform patent clearance reviews, and work with outside counsel to identify patentable inventions:
    • Attend product review meetings;
    • Analyze all processed patent clearance workflows and determine which need to be reviewed by Patent attorney;
    • Manage prioritization of patent clearance workflow to meet product review deadlines;
    • Main point of contact for patent clearance procedures and issues;
    • Track products through the product review and search processes; and
    • Review and close out all entries in our product tracking database.
  • Draft provisional and utility applications as well as responses to Office Actions and coordinate internally as well as with outside counsel on efficient and effective prosecution.
  • Managing the patent portfolio in all aspects of development and maintenance of the portfolio and support contract and licensing activities.
EDUCATION AND WORK EXPERIENCE:
  • Minimum 6-8 years experience drafted at least 50 patent applications and registered with the USPTO.
  • BS degree in Electrical Engineering (M.S. or PhD preferred) with prior patent / IP experience in the area of electrical engineering, mechanical engineering, physics and software relating to consumer products, toys and games.
  • Demonstrate strong written, verbal communication and people skills with technical depth and patent expertise, a high degree of attention to detail and the ability to organize assignments, work under pressure and meet deadlines.
  • Demonstrated experience identifying technologies that can be patented.
  • Self-motivated and able to work independently and accurately as well as with a team.
