The antitrust committee educates the membership of the association regarding the relationship between intellectual property law and antitrust law. The impact antitrust law has on competition and the enforcement of intellectual property vacillates with the political climate. Currently, antitrust law is particularly apparent in patent “pay for delay” antitrust actions. Committee members review changes in antitrust laws as well as actions taken by the Federal Trade Commission, the Antitrust Division of the U.S. Department of Justice, and private attorneys general to enforce antitrust laws as they may impact intellectual property laws and intellectual property enforcement. The committee provides education through seminars by knowledgeable practitioners and regulators as well as brown bag lunches.
