On December 5, 2017, an oral hearing was conducted at the Court of Appeals for the Federal Circuit in Momenta Pharmaceuticals v. Bristol-Myers Squibb addressing the standing required by a petitioner in order to appeal a Final Written Decision of an inter partes review by the Patent Trial and Appeal Board (PTAB) to an Article III court.  This case is particularly significant because the facts suggest any activity by the petitioner that would likely be necessary to establish injury-in-fact might be contingent upon prior approval from the Food and Drug Administration (FDA) under the Biologics Price Competition and Innovation Act (BPCIA) of 2009. 

Issues that will be discussed at our meeting on January 19th, include: 

1.  The minimum threshold for Article III standing for a petitioner to appeal from the Board to the Federal Circuit; 

2.  Whether the BPCIA delimits injury-in-fact necessary to establish Article III standing; and  

3.  Whether a losing petitioner in an IPR is, or should be estopped from making the same (or the same available) arguments during infringement litigation if Article III standing to appeal the final Board decision to the Federal Circuit cannot be established.
