While US patent law has been largely codified by Title 35, many crucial legal doctrines remain common-law based. Doctrine of equivalents…implicit exceptions to patent eligibility…experimental use…obviousness-type double patenting…unenforceability based upon inequitable conduct… Do these common law doctrines result in unstable and unpredictable jurisprudence or, alternatively, do they provide the needed degree of flexibility?

IP law experts will discuss whether and how these controversial judicial doctrines should be superseded by amendment of the US Patent Code.
