 BPLA Case Law Committee

The BPLA Case Law Committee will meet for a lively discussion of the recent damages verdict in Promega v Life Technologies on Friday December 15th at 8:30 am at the Hamilton Brook Smith and Reynolds offices in Concord. Registration and networking start at 8:15.

In Promega v. Life Technologies, Defendant admitted infringement under § 271(a), yet Plaintiff ultimately received no damages under § 284. One has to ask just how this did happen.  Let’s take this opportunity to review an admittedly unusual case, where a Supreme Court remand pertaining to § 271(f)(1), a Plaintiff special verdict form providing jury instructions, a Defendant Rule 50(b) motion and (deficient) Plaintiff response, and Plaintiff’s burden to prove damages all combined to alleviate Promega of its ability to enjoy a lost profits damages award.
